By downloading, installing, or using VocaFlip ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

VocaFlip is a language learning application that provides:

• German vocabulary flashcards with spaced repetition
• Interactive learning games and exercises
• Progress tracking and statistics
• Custom word lists and study sessions
• Optional account creation for data synchronization

3. User Accounts

3.1 Account Creation

You may use VocaFlip without an account (guest mode) or create an account for additional features. When creating an account, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Termination

You may delete your account at any time through the app settings or by visiting our account deletion page. We reserve the right to terminate accounts that violate these Terms.

4. User Content

You retain ownership of any custom vocabulary words or content you create. By using the App, you grant us a limited, non-exclusive license to store and process this content solely for providing the service.

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or hack the App
• Transmit viruses, malware, or malicious code
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Use automated systems to access the App
• Circumvent any security measures

6. Intellectual Property

The App and its original content (excluding user-generated content) are owned by Takemeway Studio and are protected by copyright, trademark, and other intellectual property laws. The German vocabulary content is used for educational purposes under fair use provisions.

7. Premium Features and Payments

7.1 In-App Purchases

VocaFlip offers optional premium features through in-app purchases. All purchases are:

• Processed through the App Store (iOS) or Google Play Store (Android)
• Subject to the respective store's terms and conditions
• Non-refundable except as required by law or store policy
• Tied to your store account, not your VocaFlip account

7.2 Premium Benefits

Premium subscription includes:

• Ad-free experience
• Unlimited custom words
• Advanced statistics and insights
• Priority customer support
• Early access to new features

8. Advertisements

The free version of VocaFlip displays advertisements through Google AdMob. These ads are subject to Google's privacy policies. You can remove ads by purchasing the premium version.

9. Privacy and Data Protection

Your use of VocaFlip is also governed by our Privacy Policy. We are committed to protecting your privacy and complying with applicable data protection laws including GDPR and CCPA.

10. Disclaimers and Limitations of Liability

10.1 "As Is" Service

VocaFlip is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the maximum extent permitted by law, Takemeway Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to your data
• Errors or omissions in content
• Any third-party services or content accessed through the App

10.3 Educational Content Disclaimer

VocaFlip is an educational tool. We do not guarantee specific learning outcomes or language proficiency results. Individual results may vary based on usage patterns and personal learning abilities.

11. Indemnification

You agree to indemnify and hold harmless Takemeway Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the App.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through:

• In-app notifications
• Email to registered users
• Prominent notice on our website

Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the European Union and the Federal Republic of Germany, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in Germany.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
